RE: The tariff classification of aluminum hinges from Malaysia, Singapore, Taiwan or China

Dear Mr. Lam:

In your letter dated October 20, 2010, you requested a tariff classification ruling. Pictures of the product were submitted with your request.

The merchandise under consideration is aluminum hinges, product number SY-AD109 (M14-0005). These are continuous hinges (also known as piano hinges) that you have indicated will be used on doors. They come in various lengths, ranging from 83.19 inches to 118.81 inches long. Each hinge is made of aluminum alloy and produced by an extrusion process. The Aluminum Association Series Designation for these hinges is 6063-T5. They are packed sixty hinges per cardboard box upon importation.

The applicable subheading for the aluminum hinges will be 8302.10.6030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases, windows, blinds, coachwork, saddlery, trunks, chests, caskets or the like, hinges and parts thereof, of iron or steel, of aluminum or of zinc, other, suitable for interior and exterior doors (except garage, overhead or sliding doors). The general rate of duty will be 3.5 percent ad valorem.

The aluminum extruded hinges from China may be subject to antidumping duties or countervailing duties. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs and Border Protection. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
